North East Misconduct Investigation Specialists, TVI are regularly instructed to undertake investigations on behalf of employers where there is/has been suspected Gross Misconduct or Misconduct behaviour and/or where there is a strong belief that it will occur in the near future.
The Difference
Gross Misconduct includes offences of a criminal nature such as fighting, theft, drunkenness or harassment. Misconduct can include poor time keeping, an unjustifiable absence or a refusal to follow reasonable management instructions.

TVI are a Teesside based specialist employment defence service which investigates cases of Gross Misconduct or Misconduct in an open, fair and transparent way, gathering the evidence, piece meal if necessary and presenting the facts in a clear, logical and evidence based format. This enables employers to weigh up an independent investigation, review the case and consider whether it is necessary to proceed with a discipline hearing.
The way in which this takes place can be critically important for employers and there are a number of overarching principles which TVI follow to ensure that throughout the process of investigation and indeed potential discipline hearing, employers understand and benefit from a sound and legally compliant investigation, one which must be followed in order to prevent failings which may otherwise prove both costly and unjust in later stages.
It is important to understand the consequences of an ineffective discipline hearing because an investigation precedes this and if the investigation has not been conducted both fairly and thoroughly it will follow that the discipline hearing may prove flawed.
Code of Conduct
All investigations are conducted within a framework of legality, proportionality and necessity and follow a rigorous policy of respecting the principles enshrined within Article 8 Human Rights Act 1998 and the Regulation of Investigatory Powers act 2001. TVI is also fully registered and protected with the Information Commissioner under the Data Protection Act 1998.
